4.2. Modification des moyens invoqués par une partie

Les dispositions des art. 12(4) RPCR 2020, art. 13(1) RPCR 2020 et art. 13(2) RPCR 2020 s'appliquent si une partie a modifié ses moyens (ou une partie de ses moyens).
Dans l'affaire J 14/19, la chambre a expliqué que le point de référence pour déterminer s'il y a eu modification des moyens invoqués conformément à l'art. 13(1) ou (2) RPCR 2020 est le mémoire exposant les motifs du recours ou sa réponse. En ce qui concerne l'art. 12(4) RPCR 2020, le point de référence pour déterminer si une partie des moyens invoqués doit être considérée comme une modification est la décision attaquée.
En outre, selon l'art. 12(4) RPCR 2020, les moyens sur lesquels la décision de première instance ne s'était pas fondée ne sont pas considérés comme des modifications si la partie à la procédure de recours démontre que ces moyens ont été valablement soulevés et maintenus jusqu'à la décision de première instance; voir également CA/3/19 (publication supplémentaire 2, JO 2020), remarques explicatives relatives à l'art. 12(4) RPCR 2020, 3e paragraphe.
