3.2. Moyens au titre du PCT appliqués par l'OEB agissant en qualité d'office désigné
Dans la décision J 13/16, la chambre de recours juridique a retenu que si, pendant la phase internationale, un office récepteur a restauré un droit de priorité sur la base du critère d'inobservation non intentionnelle prévu à la règle 26bis.3.a)ii) PCT, la restauration n'est pas effective dans le cadre d'une procédure devant l'OEB agissant en qualité d'office désigné, étant donné que l'OEB applique le critère de "diligence requise" (règle 49ter.1.b) PCT). En pareil cas, le demandeur doit présenter, dans le délai prévu à la règle 49ter.2.b)i) PCT, une (nouvelle) requête en restauration du droit de priorité au titre de la règle 49ter.2 PCT auprès de l'OEB agissant en qualité d'office désigné. Aux fins de la règle 49ter.2 PCT, la requête présentée auprès de l'office récepteur au titre de la règle 26bis.3.b) PCT ne pouvait pas être prise en compte dans la procédure devant l'OEB agissant en qualité d'office désigné. Une requête en restauration de droits telle que prévue à la règle 49ter.2 PCT est réputée ne pas avoir été présentée si la taxe applicable n'a pas été acquittée dans le délai pertinent (J 8/18, J 1/19).

The PCT Assembly may be considered the legislator for the PCT Regulations.
